Terms of Use

Please read these Terms carefully. They include a binding arbitration clause and class action waiver that affect your legal rights. By using Kindred, you agree to these Terms.

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legal agreement between you and SHOBEL LLC d/b/a Kindred Parenting ("Kindred," "we," "us," or "our"), the company behind the Kindred mobile application and website at meetkindred.app (collectively, the "Service").

By downloading, installing, or using the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them along with our Privacy Policy. If you do not agree, do not use the Service.

2. Your Account

To use Kindred, you must create an account by providing your name, email address, and any other information requested during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

If you believe your account has been accessed without your authorization, notify us immediately at hello@meetkindred.app.

3. The Service

Kindred provides an AI-powered parenting coaching application that helps parents understand and support their children's development. Features include personalized coaching, growth tracking, journaling, daily child development insights, and co-parenting support.

We may update, modify, or discontinue any feature of the Service at any time without notice or liability.

4. AI Coaching Disclaimer

Kindred is not a substitute for professional medical, psychological, or therapeutic advice. The AI coaching provided by the Service is for general informational and educational purposes only and does not constitute professional mental health, medical, or clinical advice.

Using Kindred does not create a therapist-patient, doctor-patient, or any other professional relationship between you and Kindred or its team. Always consult a qualified healthcare or mental health professional for specific concerns about your child's wellbeing. Never delay seeking professional advice based on information from the Service.

AI-generated responses may occasionally be inaccurate or incomplete. You assume full responsibility for how you interpret and act on the guidance provided. If you or your child is experiencing a mental health crisis or emergency, discontinue use and contact emergency services immediately.

5. Children's Information

Kindred is designed for use by adults (parents and caregivers). You may enter information about your children to personalize the coaching experience. By doing so, you represent that you are the parent or legal guardian of the children whose information you provide, and that you have the right to share that information with us.

We do not knowingly collect personal information directly from children. See our Privacy Policy for details on how we handle information about minors that you provide to us.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Upload or transmit viruses, malware, or other harmful code
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Reproduce, distribute, or create derivative works from any part of the Service without our written permission
  • Use the Service to harass, defame, or harm others
  • Misrepresent your identity or create accounts for fraudulent purposes
  • Scrape, data-mine, or use automated means to access the Service

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, software, trademarks, and the Kindred name and logo — are owned by Kindred or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes in accordance with these Terms. No other rights are granted.

8. Subscriptions and Billing

Some features of Kindred require a paid subscription. Subscriptions are offered on a monthly or annual basis and are billed through Apple's App Store. All payments are processed by Apple; Kindred does not collect or store your payment information directly.

Subscription fees are charged at the beginning of each billing period and are non-refundable except as required by applicable law or Apple's policies.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage and cancel your subscription at any time through your Apple ID account settings.

9. Cancellation

You may cancel your Kindred subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of your current billing period; you will retain access to premium features until then. We do not issue pro-rated refunds for unused portions of a billing period.

For refund requests related to App Store purchases, please follow Apple's standard refund process.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KINDRED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINDRED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR EMOTIONAL DISTRESS — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO KINDRED IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold Kindred and its officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

13. Dispute Resolution and Arbitration

Please read this section carefully. It requires individual arbitration and waives your right to a class action or jury trial.

Informal Resolution: Before initiating any formal dispute, you agree to first contact us at hello@meetkindred.app and attempt to resolve the issue informally. If the dispute is not resolved within 60 days, either party may proceed to arbitration.

Binding Arbitration: Any dispute, claim, or controversy arising from or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court. The arbitration will take place in New York, New York, unless otherwise agreed.

Class Action Waiver: You agree that any arbitration or legal proceeding will be conducted on an individual basis only. You waive the right to participate in a class action lawsuit or class-wide arbitration.

Governing Law: These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and associated data by contacting us at hello@meetkindred.app or through the in-app account deletion feature.

15. Notice Regarding Apple

These Terms are between you and Kindred only — not Apple Inc. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support. If the Service fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation with respect to the Service.

Apple is not responsible for addressing any claims relating to the Service, including product liability claims, consumer protection claims, or claims that the Service fails to meet applicable legal requirements. Apple is also not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim relating to the Service.

You agree to comply with all applicable third-party terms when using the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by in-app notification. Continued use of the Service after any changes constitutes your acceptance of the new Terms.
